In February of 2015, Trivedi & Khan, on behalf of a retail client, successfully defeated a large breach of contract claim brought by a landlord based on an alleged premature termination of lease. Judge Eileen Burke of the Circuit Court of Cook County ruled in the commercial tenant’s favor on summary judgment based on the lease language. Trivedi & Khan’s written and oral advocacy, led by attorney Zubair Khan, convinced the Court that the tenant was permitted to terminate lease based on certain conditions precedent not met by the landlord. Ultimately, the tenant was able to dismiss a claim seeking over $700,000. The client also brought a counterclaim against the landlord which was subsequently settled out of court.
