Trivedi & Khan, P.C. successfully litigated a property dispute involving the ownership of a large mall in Joliet, IL. The client purchased the strip mall under an agreement to re-sell the property to the seller if certain conditions were met. The seller acted as the manager of the property. It was discovered that the seller was posing as the owner and had secretly leased out spaces in the mall and kept the extra rent collected from tenants. Trivedi & Khan convince the trial court that the agreement was valid, and that the seller had no rights to rescind the agreement. Ultimately, the Court awarded ownership of the mall to Trivedi & Khan’s client along with $900,000 in damages for breach of contract.
The seller attempted to appeal the ruling, but the Appellate Court of Illinois upheld the court’s decision, finding no error in refusing to rescind the sales contract. Mr. Zubair Khan and the litigation team successfully secured exclusive ownership of the strip mall for the client and ensured they received $900,000 in damages.
